23XI and FRM claim court ruling sets “dangerous precedent” as they appeal decision

23XI Racing and Front Row Motorsports are facing the possibility of losing their charters mid-season due to a recent legal setback, leading to significant financial repercussions for the two multi-car teams.

The U.S. Court of Appeals ruled in favor of NASCAR on June 5th, revoking the preliminary injunction that allowed 23XI and FRM to compete with chartered status during the ongoing antitrust lawsuit.

Both teams have now appealed this decision and are seeking a rehearing before the full court to overturn the ruling by the end of June.

The lead attorney for 23XI and FRM, Jeffrey Kessler, emphasized that the lawsuit aims to make NASCAR more competitive and fair, highlighting the alleged anticompetitive tactics employed by the organization.

Despite facing legal challenges and the impending loss of their charters, both teams remain committed to racing the full season, with the trial date for the lawsuit scheduled for December as the legal battle between the teams and NASCAR continues to escalate.
